El título de esta intervención, que es obra de los organizadores del ciclo, debo advertirlo, nos obliga, por lo menos a primera vista, a colocar el punto de partida de nuestras reflexiones en el momento de la entrada en vigor de la Constitución, toda vez que es en ella donde España se organiza como Estado social y democrático de derecho. Sin embargo, tal vez convenga ir un poco más atrás. Ante todo, porque en materia jurídica los cambios no se producen nunca milagrosamente por obra de los textos normativos.
