Three principles of justice in migration policy

This paper proposes three key principles of justice in migration policy. First, the principle of assistance posits that rich states have the primary obligation to assist the poor in their home countries, and only a secondary obligation to take in those who cannot be assisted where they live. Second, the principle of restraint claims that the use of coercion must be proportional to the end pursued, such that only in situations of imminent, direct, and serious risk would immigration restrictions be justified. Lastly, the principle of restitution requires that, whenever it is necessary to restrict immigration, this restriction be partial and temporary. States must ensure alternative transit routes and restore freedom of movement as soon as possible. The article also considers some objections to its proposal and concludes with a defense of the international governance of migration.
